West Newbury, Massachusetts

West Newbury additions and ADUs, sited around the septic field and the well

  • Main Street (Route 113)
  • Training Field
  • Pipestave Hill
  • Mill Pond
  • River Road

Lots in West Newbury run large: across most of the south of town the zoning minimum is 80,000 sq ft. On those lots, room is seldom the limit. The septic system's permitted bedroom count is, along with the distance to a private well and, on riverfront lots, the Merrimack's flood line. We pull the Board of Health file and book the surveyor early.

The houses of West Newbury, era by era

West Newbury is a town of rolling hills, orchards and farmland on the south bank of the Merrimack, about 10 miles upriver from the ocean. It split from Newbury in 1819, first under the name Parsons, and took its current name a year later. More than 90 percent of its homes are detached single-family houses, many on large lots, and there is no centralized town sewer.

  1. 1600s–1730s

First Period houses on Main Street (late 1600s to 1730s)

Route 113 carries the oldest houses, several on the National Register: the Samuel March House from the late 17th century, the Rev. John Tufts House and the brick Samuel Chase House from about 1715, and the Timothy Morse House, begun in 1730. Most are timber-framed and often have low ceilings and sills that have rotted or settled. Inside the Training Field Historic District, any exterior change needs a certificate before the building permit.

  2. 1960s–1990s

Houses from the 1960s through the 1990s

Building picked up after 1960 and ran steadily from 1970 to 1999, so a large share of West Newbury houses come from those decades. Their septic systems were sized for the bedrooms they were built with. That is the number to find before planning a primary suite, a bedroom over the garage or an in-law unit.

  3. 03

    Riverfront lots on River Road

Along the Merrimack, some lots sit in or near the Zone A and AE floodplain on the July 2025 flood map, and erosion along River Road came up at the 2024 Town Meeting. Check the map and Conservation Commission jurisdiction before fixing an addition's footprint. Docks or shoreline structures add a state Chapter 91 license.

What local rules, the ground and the energy code ask of a project here, each with the source we checked. Rules change and some depend on the parcel, so we confirm them with the building department before anything is drawn.

  1. Septic

No town sewer, and many private wells

West Newbury homes rely on individual septic systems under Title 5, which sizes the system by bedroom count. Town water reaches about 63 percent of the town; the rest is on private wells. So the permitted design flow and the required well-to-septic and well-to-foundation distances often decide where, and whether, an addition or detached ADU fits. See Title 5 and adding bedrooms.

  2. ADU rules

    Two kinds of ADU

Since the 2025 Annual Town Meeting, a protected ADU of up to 900 sq ft, or half the house if smaller, is allowed by right in single-family districts. A special-permit ADU can run from 900 to 1,500 sq ft, never more than half the house, but it needs a Planning Board special permit, an owner-occupied home with a filed affidavit, no new curb cut and a clearly secondary entrance. 3. Historic district

    The Training Field Historic District

Inside the district, nothing can be built, demolished, moved or altered in a way that affects its exterior without a Historic District Commission certificate, and the building inspector cannot issue a permit until that certificate is in hand. The town's bylaws contain no demolition delay. More on historic renovation.

  4. Local note

    The Groundwater Protection Overlay

Inside the mapped aquifer and recharge district, making more than 15 percent of a lot or 2,500 sq ft impervious, whichever is greater, takes a Planning Board special permit and a recharge system. Large additions, long driveways and patios count. Check the district map for the property early.

  5. Coastal & wetlands

    Riverine floodplain, state wetlands rules

West Newbury is not on the ocean, but its Floodplain Overlay District covers Zone A and AE areas on the July 8, 2025 flood map. The local wetlands bylaw adopts the state Wetlands Protection Act rather than adding its own buffers; a stricter replacement failed at the 2024 Town Meeting. Work near wetlands or the Merrimack still needs Conservation Commission filings.

  6. Energy code

    Stretch code since 2014

Town Meeting adopted the Stretch Energy Code in April 2013, effective January 1, 2014, and West Newbury has been a Green Community since that December. It is not on the Specialized code. Additions over 1,000 sq ft of conditioned space need a HERS rating. See the stretch code and additions.

What we build here

What we build in West Newbury

  • Home additions

On a West Newbury lot the addition usually fits; the question is where. We site it against the septic field, reserve area and well before design, and line up the surveyor for the town's foundation plot plan before framing.

  • ADUs and in-law suites

West Newbury allows a larger special-permit ADU, up to 1,500 sq ft, for owner-occupied homes, which suits an in-law unit with real bedrooms. We check whether the septic can carry those bedrooms before anyone falls for the bigger plan.

  • Historic renovation

The First Period houses on Main Street need sill, frame and chimney work done in the right order. In the Training Field district we design to the Historic District Commission's review from the start.

Questions

Questions we hear in West Newbury

Can I add an ADU to my home in West Newbury?

Yes. Since the 2025 Annual Town Meeting, a protected ADU of up to 900 sq ft, or half the main house if that is smaller, is allowed by right in single-family districts, subject to the usual dimensional rules. A larger unit, from 900 to 1,500 sq ft, needs a Planning Board special permit; you must live in one of the units and file an owner-occupancy affidavit, and no new curb cut is allowed. With no town sewer, the septic system also has to support the added bedrooms.

Will my septic system limit an addition or an extra bedroom?

Often, yes. Title 5 ties septic design to the number of bedrooms. If the existing system was not permitted for the count you want, plan on Board of Health review and possibly soil testing and an upgrade before the building permit. On lots with a private well, separation distances can also limit where new construction goes.

What does West Newbury's Foundation Bylaw require?

Once the foundation is in, the town requires a certified plot plan at 1 inch = 20 feet, sealed by a registered land surveyor, showing the foundation's location and yard setbacks. Book the surveyor before framing so the submission does not hold up the job.

Are there historic or wetlands rules that could slow my project?

Inside the Training Field Historic District, exterior changes need a Historic District Commission certificate before a building permit. The town has no demolition delay bylaw, and its wetlands bylaw follows the state act rather than adding local buffers. Work near wetlands or the Merrimack still needs Conservation Commission filings, and the Groundwater Protection Overlay District can require a special permit for large impervious areas. Confirm specifics with the town.
